Breve apunte de Literatura y Derecho sobre Jacob Grimm

El Instituto de Estudos de Literatura Tradicional de la Faculdade de Ciências Sociais e Humanas da Universidade Nova de Lisboa ha organizado entre los dias 21 y 23 de este mes de junio un magnífico Simpósio internacional sobre el legado dos Grimm en diferentes lugares del mundo. Como puede observarse, el programa arriba reproducido ofrece todo género de perspectivas, y entre ellas figura asimismo la ligada a la corriente de estudios sobre Derecho y Literatura. Permítanme aquí una breve nota al respecto. De los dos hermanos fue Jacob quien más destacó en el mundo del Derecho. Así, es relativamente frecuente hallar citado su trabajo “Von der Poesie im Recht” [en Zeitschrift für Geschichtliche Rechtswissenschaft, II (1816), pp. 25-99]. Menos a menudo se indica algo relativo a su contenido. Se trata de un estudio acerca de la imaginación poética nacional, con enfoques antropológico-culturales. También cabe acudir a la edición cuidada por Theodor Matthias y publicada el año 1915 con el título de Der deutsche Gedanke bei Jakob Grimm, in Grimms eignen Worten dargestellt (It. Voigtländer, Leipzig, 48 pp.; reprod. facsímil por Nachdr, Bremen 1983.), que a modo de antología reúne fragmentos de su obra en torno al tema de la “idea alemana”.

En realidad, esa misma idea es la que habrá de inspirar otro trabajo posterior, mucho menos habitual en las referencias bibliográficas. Me refiero a Deutsche Rechtsaltertümer, del año 1828, con el que obtuvo el Doctorado en Derecho por las Universidades de Breslau y Berlín, facilitándole además el mérito académico por el que más tarde alcanzó una plaza de docente por la Univesidad de Gotinga (1830), donde permaneció hasta 1837. Se ha ocupado de todo ello Ruth Schmidt-Wiegand en su estudio “Das sinnliche Element des Rechts: Jacob Grimas Sammlung und Beschreibung deutscher Rechtsaltertümer,” en Ludwig Denecke (ed.), Kasseler Vorträge in Erinnerung an den 200. Geburtstag der Brüder Jacob und Wilhelm Grimm, Elwert, Marburg, 1987, pp. 1–24. Aunque existen ediciones del Deutsche Rechtsaltertümer en los años 1854 y 1881, es la de 1889, al cuidado de Rudolf Emil Gustav Hübner como editor científico, que figura como 4ª ed. (Dieterich'sche Verlagsbuchhandlung Th.Weicher, Leipzig, 2 v.) sin duda la mejor. Una reprod. facsímil se localizará en Olms Vlg., Hildesheim, 1992 (ISBN: 978-3-487-09596-7).

Merced a estos dos trabajos, y en especial al último, puede tenerse a Jacob Grimm entre los más notables historiadores del derecho alemán. Si no llegó a profundizar más en esa línea fue antes por lo absorbente de su dedicación a la redacción del Deutsche Weisthümer que por desinterés. Acúdase a la edición de varios epistolarios en los que Jacob Grimm efectivamente mantiene correspondencia con importantes historiadores del derecho alemán; vid. Wilhelm Oechsli (hrsg. von), Briefwechsel Johann Kaspar Bluntschlis, mit Savigny, Niebuhr, Leopold Ranke, Jakob Grimm und Ferdinand Meyer, Huber, Frauenfeld, 1915.
